OFFICIAL RULES
NO PURCHASE, PAYMENT OF ANY KIND OR INSURANCE QUOTE NECESSARY TO ENTER OR TO WIN. SWEEPSTAKES OPEN ONLY TO LEGAL RESIDENTS OF THE STATE OF INDIANA WHO ARE BOTH AT LEAST 21 YEARS OF AGE AND REGISTERED MEMBERS OF THE SWEEPSTAKES WEBSITE ON DATE OF ENTRY. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
1) PROGRAM DESCRIPTION/TIMING/SPONSOR: The Bankers Life “Game Six Playoff Payoff” Sweepstakes (the "Sweepstakes”), begins
2) HOW TO ENTER: To receive a Sweepstakes entry, access the Sweepstakes website online at www.bankerslife.com/gamesix (the “Website”) during the Sweepstakes Period and complete and submit a registration form for the Sweepstakes website. The registration form will request: first and last name, mailing address, email address, phone number and birth date. Limit one (1) Sweepstakes entry per person/email address for entire Sweepstakes period. Entries received without complete information will be void. All material submitted becomes the sole property of Sponsor and will not be acknowledged or returned.
3) PROGRAM ELIGIBILITY: The Sweepstakes is open only to legal residents of the State of Indiana who are 21 years of age or older at time of entry. Void in all other 49 United States, the District of Columbia, Puerto Rico, all U.S. Territories and Possessions and where prohibited or restricted by law. Employees of Bankers Life & Casualty Company (“Sponsor”), CNO Financial Group, Inc., Pacers Basketball, LLC d/b/a Indiana Pacers, Pacers Sports & Entertainment and Home Court, the National Basketball Association and its Member Teams, NBA Properties, Inc., and promotional agencies involved in the Sweepstakes, including Marden-Kane, Inc. (the "Administrator"), and each of their respective parent companies, subsidiaries, and affiliates, and their immediate family members (spouse, parents, siblings, and children) or members of the same household of any of the foregoing persons are not eligible to participate. By entering, you agree to these Official Rules and the decisions of the judges, which shall be final and binding in all respects. All applicable federal, state, and local laws and regulations apply. In the event of any discrepancy between these Official Rules and any other communication regarding the Sweepstakes, these Official Rules shall govern and control.
4) SWEEPSTAKES DRAWING/WINNER SELECTION PROCESS: The potential Sweepstakes Prize Winners will be selected in a random drawing from among all eligible Sweepstakes entries received on or about 4/27/16 under the supervision of Marden-Kane, Inc. an independent judging organization, whose decisions are final on matters relating to this sweepstakes drawing. Odds of winning depend on the number of eligible Sweepstakes entries received during the Promotion Period.
5) POTENTIAL WINNER NOTIFICATION PROCESS: The potential winners will be called on the telephone between 9AM and 5PM ET and sent an email on/about the notification date noted above. If a potential winner is not at home when he/she is called, Marden-Kane will attempt to leave a message for the potential winner to call or email back to either accept or decline the prize. If Marden-Kane does not receive a return call within 4 hours from the time the first call is placed to the potential winner, or if the phone number called is not in service, disconnected, does not belong to the potential winner or is not able to accept voice mail messages, or if Marden-Kane does not receive a return email within 2 hours from the time the first email is sent, the prize will be forfeited and, at Sponsor’s discretion, awarded to an alternate potential winner. Sponsor is not responsible for suspended or discontinued phone service or a change of email address which may result in a potential winner not receiving initial prize notification. When a potential winner accepts the prize, he or she will then receive confirmation via email and may be required to execute and return an Affidavit of Eligibility, Liability Release and a Publicity Release (as allowed under the law), within 24 hours following issuance of notification. Non-compliance within this time period or return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner (time permitting). If, in the Sponsor’s sole discretion, it is determined that: any entry has not complied with these Official Rules, Sponsor is unable to contact a potential winner within a reasonable time period, a potential winner has failed to properly execute and return any required documents within the specified time period, has made false statements, or notification is returned as undeliverable, then such entry will be disqualified. If any entrant is disqualified for any reason, at Sponsor’s discretion, a runner-up may be selected and/or issued the applicable prize (time permitting). Should a potential prize winner decide to decline the prize for any reason whatsoever, Sponsor shall have no further obligation to that potential winner, and an alternate potential winner will be selected, time permitting. Sponsor’s decisions are final and binding on all matters.
6) PRIZES: One (1) Prize: One winner to receive a pair of Club level Seats (2 tickets) to the Indiana Pacers First Round Playoff, Game 6, scheduled for Friday, April 29, 2016, time of game to be determined. (if the Pacers do not make it to Game 6, then an alternate prize will be awarded. The alternate prize is two (2) tickets to an Indiana Pacers 2016-2017 Season Home Game, date to be determined by Sponsor at time of award). Approximate Retail Value (“ARV”) of Game Six Prize is :$200 ($100/ticket). Approximate retail value of alternate prize is : $200 ($100/ticket).
Prize winner and his/her guest must agree to comply with all NBA venue rules and regulations relating to the use of NBA regular and post-season tickets (as applicable) and, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person at such game. Failure to do so may result in forfeiture of prize or prize element.
7)PRIZE RESTRICTIONS: All prizes or substitutes will be awarded provided a sufficient number of qualified eligible entries are received and the potential winner(s) or alternative winner(s) can be contacted in accordance with Section 6 of the official rules. Sponsor, Administrator, Pacers Basketball, LLC d/b/a Indiana Pacers, Pacers Sports & Entertainment and Home Court ("Pacers") and their parents, affiliates, subsidiaries, officers, directors, employees, agents and representatives disclaim any and all representations and warranties, express or implied, in fact or in law, in connection with all prizes. Winners executing Affidavit of Eligibility and other Prize Claim documents constitutes permission for the Sponsor and its designees, and the Pacers, the National Basketball Association and its Member Teams and NBA Properties, Inc., to use the winner's name, voice, actual or simulated likeness, and biographical information (including, without limitation, for advertising and promotional purposes) in perpetuity, throughout the universe, in all media whether now known or hereafter devised, without additional compensation, unless prohibited by law. All taxes, fees, and surcharges on the prize and all other expenses not specified herein are the sole responsibility of the prize winner. Any documents including vouchers and/or tickets awarded to the prize winner become the responsibility of the winner upon possession of same and will not be replaced. Any vouchers/tickets awarded are subject to terms and conditions stated thereon. Sponsor reserves the right to substitute a prize of equal or greater value if entire prize or a portion of the advertised prize is unavailable for any reason. No barter, transfer, or assignment of any prize permitted, except by Sponsor at its sole discretion. Some restrictions may apply and all terms and conditions of the prizes offered will be furnished at the time of prize notification and/or award.
8) GENERAL CONDITIONS: Entrants agree to be bound by the terms of these Official Rules. “Released Parties” (as defined below) assume no responsibility for lost, late, illegible, garbled or misdirected entry materials, or for any computer, online, telephone, human, or other error or for any technical or other malfunctions that may occur. No mechanically reproduced, illegible, incoherent, unusable, or incomplete entries will be accepted. Proof of e-mailing or submission does not constitute proof of delivery. All information is collected in the United States of America. Released Parties are not responsible for typographical errors or any other errors in entries submitted. Entries not complying with all rules are subject to disqualification. By entering, each entrant forever releases, discharges, and waives any and all claims, liabilities and actions of any kind, howsoever caused or arising and whether by negligence, any intentional act or otherwise, that entrant may have or may arise against Pacers Basketball, LLC d/b/a Pacers Sports & Entertainment, Indiana Pacers and Home Court, the National Basketball Association and its Member Teams, NBA Properties, Inc., Marden-Kane, Inc., Sponsor and each of their respective parents, subsidiaries, affiliates, advertising and promotions agencies, prize suppliers, and related entities, as well as each of the aforementioned parties’ respective directors, officers, owners, shareholders, members, employees, representatives, successors, assigns and agents (collectively, “Released Parties”), with respect to or arising out of either (i) entrant’s participation; or (ii) the receipt or use of the prizes (including but not limited to the substitution or changing of any prizing) awarded in this Sweepstakes. By entering, each entrant further agrees to defend, indemnify and hold harmless the Released Parties and their insurers against any and all damages, costs, judgments, and/or expenses (including but not limited to attorneys’ fees and/or other legal fees) they may incur as a result of claims made against them in connection with either (i) entrant’s participation; or (ii) the receipt or use of the prizes (including but not limited to the substitution or changing of any prizing) awarded in the Sweepstakes.
9) INTERNET: The use of any automated launching or entry software or any other mechanical or electronic means that permits the entrant to automatically enter repeatedly (as solely determined by Sponsor) is prohibited. If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, uploads of malicious files or viruses, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion, to disqualify any entry or any individual who tampers with the entry or voting process, and to cancel, terminate, modify or suspend the Sweepstakes and select winners using all eligible, non-suspect entries and/or votes received as of the date of termination. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
10) JURISDICTION: The Sweepstakes is governed by the laws of the United States. All federal, state and local laws and regulations apply. The construction, validity and interpretation of the Sweepstakes shall be governed by the laws of the State of Indiana, without giving effect to any choice of law or conflict of law rules. All disputes, claims and causes of action arising out of or related to the Sweepstakes shall be resolved in the Superior Court of Indiana.
11) PERSONAL INFORMATION: The personal information collected through this Sweepstakes is subject to Sponsor’s privacy policy, a complete copy of which may be found at https://www.bankerslife.com/privacy-statement/. Any personal information handled by an agency or vendor of Sponsor, will be done solely on behalf of Sponsor and all such information shall be handled in conformity with Sponsor’s privacy policy. Marden-Kane, Inc. has been contracted as an independent third party administrator. The entry information is shared with Marden-Kane, Inc. for the sole purpose of the selection, notification, and the fulfillment of the prize.
12) WINNERS LIST & RULES: For the prize winners’ name or a copy of the Official Rules, send a stamped, self-addressed envelope to be received no later than April 29, 2016 to: Game Six Playoff Payoff Winners or Game Six Playoff Payoff Sweepstakes Rules, c/o Marden-Kane, Inc, 195 Froehlich Farm Blvd., Woodbury, NY 11797, Attn: SN. The name of the confirmed prize winner and Official Rules will also be posted at www.bankerslife.com/gamesix and will remain posted for 30 days after the Sweepstakes ending date.
